Legal Process Victimizing Ordinary Individuals

Unfortunately, while we all know there is injustice, the senators conducting the Senate hearings for the kasambahay Elvie Vergara is victimizing her again, over and over, using legislative hearings supposedly in aid of legislation for the benefit of Senator grandstanding.
Okay, this is an unpopular stance. The legal concept of innocent until proven guilty is sacrosanct in any democratic society. Also enshrined in the 1987 Constitution is the Senate's powers and allowed actions. These hearings, sad to say, are clearly not in aid of legislation but is a public trial where the rights of the amo are being trampled upon for supposed legislative purposes.
The latest action of placing the amo under custody for supposedly failure to provide the truth is NOT A LEGISLATIVE ACTIVITY. Determination of the truthfulness of testimony is done by a court of competent jurisdiction. The contempt power granted to the legislative branch is only for refusal to obey orders issued, such as subpoena ad testificandum and duces tecum. This was never allowed to be used to ferret the truth, as this is a judicial function.
Secondly, the Senate is the highest form of respect for the rule of law. When duly elected Senators threaten individuals invited to their hearings, such as the recent pronouncements on record by Senators Padilla and De La Rosa and Tulfo, these are unparliamentary in nature and thus should be subject to discipline by the Senate. Senators are supposed to be wise gentlemen of the highest order but unfortunately they have failed in doing their duty.
Thirdly, there is such a clause in the Constitution which is a prohibition in the passage of a bill of attainder. The bill of attainder is a law passed which either benefits or punishes one individual and/or class of individuals. Clearly, with the...

Very informative. Honestly for me the statement until proven guilty is now a big joke. Marami ng law ang pinatutupad para lang ma ma-empower ang mga gumagawa ng mali at mapawalang bisa ang mga evidence na pwedeng maidiin sila. Like kailangan ng consent ng both parties bago ireveal ang convo ng bawat isa and law regarding sharing videos ng kalokohan ng isang tao. The only time na maayos lang ang law is when law makers experience injustice of a law 1st hand or kapag natrigger ng husto ang paranoia nila. Like the law of age of consent dito sa pinas para lang mapagtakpan ang pagiging pedo nila binabaan nila ang age of consent without any condition. and only the recent revision lang nagkaroon ng kahit papaanong matibay tibay na conditions under the law regarding age of consent.

Sabi nga ng late Miriam Defensor-Santiago, there is nothing but a public entertainment. True enough, taktika nga nila ito sa nalalapit na eleksyon. Kaya nga siguro nanalo sina Padilla, Tulfo at Dela Rosa dahil sa drama. Hindi man aminin ng iba at base na rin sa dami ng boto nila, malamang people loves drama. Gusto ng mga politiko na ito maging balat sibuyas tayo, paigtingin pa ang bugso ng ating damdamin nang sa gayon, makalimutan na natin mag isip at tanggapin na ang pinapauso nila ang siyang tangkilikin. After all, kung ano nga naman ang trending, nandoon ang majority. At kung ano ang gusto ng tao, iyon ang ibibigay nila... drama, drama, drama!

There are three branches of the government: executive, legislative and judicial. At hindi lang siguro isang beses nanghimasok ang lehislatibo sa tungkulin ng hudikatura. Naalala ko pa yung impeachment trial nila kay CJ Renato Corona, minadali nila ang proseso at nagkaroon pa ng suhulan umusad lang ang pagpapatalsik sa punong hukom. Tapos maririnig ko kung kailan patay na ang dating punong hukom. Saka na nila lilinisin ang pangalan niya at wala naman palang basehan ang mga parating nila. Hindi ba gag* nga?

Isa pa to kay Corona. Porke nag hatol sya ng laban sa isang malaking ari-arian at pabor sa mahihirap. Ayun pinagtulungan sya ng pinuno natin noon at mga senador.
Wala silang sapat na dahilan para ma impeach si Corona politika lang talaga. Kawawa naman sya

Ganoon din kay CJ Sereno nang maghain ang sandiganbayan ng quo warranto petition at nagawa rin nilang mapatalsik sa pwesto ang dating punong hukom. Kaya parang tila ba wala nang kapangyarihan ang hudikatura at ang tanging umiiral na lang ay ang dalawang sangay ng gobyerno. Hindi na rin ako magugulat kung aamyendahan nila ang constitution upang alisin ang hudikatura na siyang naglimbag mismo ng constitution. Ironic isn't?

Looking at this from a different POV. I am thankful to Senators Tolentino, Bato, Jinggoy and Robin as they are helping lay the groundwork for the abolition of the Senate and pave the way for a unilateral Congress. πππ

Sana nga maging parliamentary na lang at pag isahin na lang ang senate at congress. Higit na makakatipid ang gobyerno kapag binawasan natin ang mga congressman at senador na hindi naman nagpa function nang maigi. I admire their sympathy towards the victim, I really do. Pero sana huwag nang i-publicize kasi halatadong nagpapabango lang sila sa mga mamamayang mahilig sa drama. Saka bigyan naman nila ng trabaho ang hudikatura, huwag naman sana nilang agawan. Hindi naman yata saklaw sa kanilang job description ang pagiging abogado na hindi naman lisensiyado. Pabibo na lang eh!

Nagiging sindakan at takutan nalang sila dun at halos hindi na pagsalitain ang mga resource persons nila.
