Binabalaan na kita, this is a long post! And no, this isn't about death. It's about RAPE. Lahat ng nilagay ko dito ay hindi opinyon ko lamang. Resulta po 'to ng ka-boringan ko sa harap ng aking computer. Nag-research po ako ng saglit para ilagay dito sa blog, hahaha! Practice lang ng research skills ko during my free time. Pag-usapan natin ang Rape o Panggagahasa, iniisip mo na ba agad 'yan. Huy! Hindi 'to tungkol sa kalibugan. Tara't pag-aralan natin ng mabuti ang mga elemento ng Panggagahasa. Dito sa Pilipinas, tinuturing na Heinous Crime ang Rape. Heinous, meaning kahindik-hindik o kasuklam-suklam na krimen kung saan pinapatawan ito ng pinakamabigat na parusa ayon sa Revised Penal Code of the Philippines (RPC for brevity).

Republic Act 8353, known as "The Anti-Rape Law of 1997". Hindi naman talaga taong 1997 nag-umpisa na magkaroon tayo, ang Pilipinas, ng batas laban sa panggagahasa. RA 8353 only amended the law against Rape in the RPC. Amended, meaning may binago o dinagdag. RA 8353 also re-classified Rape asCrimes Against Person (formerly from Crimes Against Chastity). Ibig sabihin, maaari nang maisampa ang kaso kahit ayaw ng biktima. RA 8353 also expanded the definition of Rape. Article 266 (A, B, C and D), in these paragraphs we will know the definition of Rape, paano ito isinasagawa at kung ano ang karampatang parusa na kaakibat nito. We will only focus on defining it and how it's done. (But don't do it, seriously... Mamatay ka na kung nasa isip mo 'yang panggagahasa, whoever you are.)

Art. 266-A

1. By a man who shall have carnal knowledge of a woman under any of the following circumstances:

(Carnal knowledge means sexual intercourse, medyo malalim lang 'yung term na ginamit dito. Legalese kung tawagin. Dito sa part na 'to, eto 'yung casual male to female sexual intercourse.

Classic definition where a man inserts his penis into a woman's genitalia... But there was a loophole before RA 8353 where a Frustrated stage of Rape where used by the accused to evade the law. Then came People v. Orita, G.R. No. 88724, where it stated that there is no Frustrated Stage in the crime of Rape. Once the penis enters the vagina, it is atuomatically consummated.

~Clearly, in the crime of rape, from the moment the offender has carnal knowledge of his victim he actually attains his purpose and, from that moment also all the essential elements of the offense have been accomplished. Nothing more is left to be done by the offender, because he has performed the last act necessary to produce the crime. Thus, the felony is consummated.

People v. Dela Pena, G.R. No. 104947 averred that the just the tip of the penis touching the labia minora or the outside skin of the vagina, constitutes the consummated crime of rape. It also held that there is no need for the accused to ejaculate, whether he did or did not will not matter.

~Settled is the rule that full penetration of the vaginal orifice is not an essential ingredient in the commission of the crime of rape. The mere touching of the external genitalia by a penis capable of consummating the sexual act constitutes carnal knowledge.

~The absence of seminal, fluid, spermatozoa, abrasions, lacerations, hematoma etc., around the genital area or the presence of an intact hymen does not automatically lead to a conclusion that no act of rape had occurred or that the act was in fact consensual.

1a) Through force, threat, or intimidation;

G.R. 214497, Quimvel v. People, ~The term "coercion and influence" as appearing in the law is broad enough to cover ''force and intimidation" as used in the Information.

QvP basically covered the simple definition of 1a with the term coercion (pamimilit) and influence (how do I explain this... hmm... parang 'yung authority ng isang taong may mataas na position or 'yung kapangyarihan niya para magtagumpayan ang kanyang plano, noteworthy dito 'yung People v. Dimanawa where it stated that respect for elders is deeply rooted in Filipino children and recognized by law such that there is a presumption that the child testified truthfully.

Dun pa lang, may influence na agad 'yung culture natin na pwedeng gamitin to take advantage or what we call moral ascendancy.)]

1b) When the offended party is deprived of reason or otherwise unconscious;

(Take note of G.R. No. 203086, People v. Dalan, in this case nag-focus 'yung trial sa pag-determine kung nangyari ba talaga ang panggagahasa at kung 'yung biktima ay wala sa sarili/katinuan, tulog o hinimatay. Walang pamimilit o impluwensyang nangyari dito.

Marami tayo nababalitaan na mga batang babae o lalaki nirerape ng kanilang pastor, ministro, mga pari etc. Sana maparusahan sila minsan kasi nakakatakas sila sa conviction gamit ang pagiging banal daw nila at lingkod

So ayan mas simpleng paliwanag.Ewan ko na kung mayroon pang may pinapantasya na irape...Sa ibang bansa ang parusa sa ganiyan ay kamatayan o worse...kinapon talaga 😆
